PeakZebra Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PeakZebra software-as-a-service platform, related products, integrations, and websites (collectively, the “Service”).

By registering an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.


1. Description of the Service

PeakZebra provides a hosted, fully configured publishing and monetization platform designed to support newsletters, membership programs, courses, video content, and related creator offerings.

The Service enables you to manage your content, build and engage with your audience, and integrate with third-party services, including but not limited to payment processors (e.g., Stripe) and email service providers. You retain ownership and administrative control over your connected third-party accounts.


2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to use the Service. By registering an account, you represent and warrant that all information you provide is accurate and complete.


3. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to notify PeakZebra immediately of any unauthorized access or use of your account.
  • You are responsible for ensuring that your use of the Service complies with all applicable laws, including but not limited to privacy, consumer protection, and intellectual property laws.

4. Ownership and Control

  • You retain full ownership of all content you create, your subscriber and customer data, your Stripe account, and any other third-party accounts you connect to the Service.
  • PeakZebra does not claim any ownership rights in your content or audience data.
  • You may export your data at any time, subject to the terms and technical limitations of third-party services.
  • PeakZebra retains all rights, title, and interest in and to the Service, including all software, technology, and related intellectual property.

5. Subscription Plans and Payment

  • Access to the Service requires an active subscription. Subscription tiers, pricing, and features are set forth at the time of enrollment.
  • Subscription fees are billed in advance and are non-refundable, except as required by applicable law.
  • If you downgrade or cancel your subscription, your access will continue through the end of the current billing period.
  • PeakZebra reserves the right to modify subscription pricing or features with reasonable advance notice.
  • All payments you collect from your audience flow directly to your own Stripe account. PeakZebra does not hold or process your subscriber funds.

6. Fees and Taxes

  • You are responsible for all taxes, duties, and government charges related to your use of the Service and to any payments received from your audience.
  • Third-party services you use (e.g., Stripe or email service providers) may charge their own fees, which are your sole responsibility.
  • PeakZebra may charge additional service fees for optional add-ons or upgrades, which will be disclosed prior to activation.

7. Acceptable Use

You agree not to use the Service to:

  • Send spam or other unsolicited communications in violation of applicable laws.
  • Publish, distribute, or promote unlawful, infringing, defamatory, or fraudulent content.
  • Mislead or defraud subscribers, customers, or other users.
  • Interfere with or attempt to disrupt the integrity, security, or performance of the Service.

PeakZebra reserves the right to suspend or terminate accounts found to be in violation of this section.


8. Third-Party Services and Integrations

  • The Service enables integrations with third-party providers, including but not limited to Stripe, email service providers, analytics platforms, and WordPress plugins.
  • Your use of third-party services is governed solely by their respective terms and policies.
  • PeakZebra is not responsible for the performance, security, or availability of third-party services.
  • If you disconnect or lose access to a third-party service, certain functionality may be impaired or unavailable.

9. Data and Privacy

  • You own your subscriber and customer data and are responsible for complying with all applicable privacy and data protection laws, including any required consents or notices.
  • PeakZebra will not sell or share your subscriber data with third parties for marketing purposes.

10. Service Availability and Modifications

  • PeakZebra strives to maintain reliable and secure service but does not guarantee uninterrupted uptime or error-free operation.
  • PeakZebra may update, enhance, or modify the Service at any time, including the addition or removal of features.
  • Material changes that impact your use of the Service will be communicated in advance when feasible.

11. Cancellation and Termination

  • You may cancel your subscription at any time through your account settings. Your subscription will remain active until the end of the billing period.
  • PeakZebra may suspend or terminate your account for material violations of these Terms, non-payment, or legal requirements.
  • Upon termination, you may export your content and subscriber data, subject to third-party service terms.
  • PeakZebra may also terminate or suspend access to the Service in the event of technical, operational, or security risks.

12. Disclaimers

  • The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • PeakZebra does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

  • To the maximum extent permitted by law, PeakZebra shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, data, goodwill, or business opportunities.
  • In no event shall PeakZebra’s total liability to you exceed the total amount of subscription fees paid by you to PeakZebra during the twelve (12) months preceding the claim.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to conflict of law principles.

Any disputes arising out of or in connection with these Terms shall be brought exclusively in the state or federal courts located in Delaware County, Pennsylvania, and you consent to the personal jurisdiction of such courts.


15. Changes to These Terms

PeakZebra may amend these Terms from time to time. If material changes are made, we will provide notice through the platform or by email. Your continued use of the Service following the effective date of any changes constitutes acceptance of the revised Terms.
